  1. L. Ron Hubbard, Scientology and Dianetics are trademarks [offsite] of the Religious Technology Center [offsite] (RTC).

  2. The Scientology Racism web site is about L. Ron Hubbard, Scientology, and Dianetics; thus, the use of these terms cannot be avoided, and is acceptable under the "fair use" principle.

  3. It is not possible to confuse Scientology Racism with any official RTC/Scientology web site because:

    • Scientology Racism does not use any logos or other images trademarked by RTC/Church of Scientology;
    • Scientology Racism's look and feel is completely different from any official web site of the RTC/Church of Scientology;
    • Scientology Racism does not sell, distribute or promote any goods or services and thus is not competing with the commercial activities of the RTC/Church of Scientology;
    • Scientology Racism is strongly critical of L. Ron Hubbard, Scientology, and Dianetics and thus its content cannot be mistaken for officially approved or endorsed material.

  4. The use of metatags that incorporate the trademarked terms is permitted, as set forth in Playboy Enterprises v. Welles [offsite],

    there [is] no trademark infringement where defendant has used plaintiff's trademarks in good faith to index the content of her website… Much like the subject index of a card catalog, the meta tags give the websurfer using a search engine a clearer indication of the content of a website.

  5. "Disclaimers are a favored way of alleviating consumer confusion as to source or sponsoship", thus a disclaimer appears in the footer of every page, linked to this page.
